Chapter 7 and Chapter 13 bankruptcy

You may be able to stop auto repossession with a Chapter 7 or Chapter 13 bankruptcy, certain assets may be liquidated. However, other assets, including automobiles, may be saved through exemptions. In addition to exemptions, you may reaffirm your debt to your vehicle in a Chapter 7 bankruptcy and still discharge credit card debts, medical bills and other forms of consumer debt.

In a Chapter 13 bankruptcy, we can submit a debt repayment plan to the United States Trustee's Office. This allows you additional time to get current on your payments and protects your vehicle. You may be able to pay just a portion of your debts and still keep your car. The Chapter 13 operates like a debt consolidation plan.
